Overview

Welcome to New Homeowner OS.

The terms “we,” “us,” and “our” refer to New Homeowner OS. New Homeowner OS operates this website and online store, including the information, content, features, digital products, tools, and services made available through it (collectively, the “Services”).

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our Services to you.

These Terms of Service (“Terms”) describe your rights and responsibilities when you access or use our website, purchase our digital products, or otherwise use the Services.

Please read these Terms carefully. By accessing or using the Services, or by purchasing a product from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

Nothing in these Terms limits any consumer rights that cannot legally be excluded or limited under applicable law.


1. Eligibility and Accounts

By using the Services, you represent that you are at least the age of majority in your state, province, or other jurisdiction of residence, or that you have the permission of a parent or legal guardian where required.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

You may not sell, transfer, assign, or license your customer account to another person.


2. Digital Products

New Homeowner OS sells digital educational and organizational products intended to help homeowners understand, organize, and track general home-maintenance activities and home information.

Product descriptions, screenshots, mockups, examples, and previews are provided to help explain the product. We make reasonable efforts to accurately represent what is included.

Because the product is digital, its appearance may vary depending on the device, operating system, software, application, screen settings, or other technology you use.

We may update, improve, replace, or discontinue products or product components from time to time. Any purchase entitles you to the version and materials made available as part of your purchase unless we expressly state that future updates are included.


3. Digital Product License

When you purchase a digital product from New Homeowner OS, you receive a limited, non-exclusive, non-transferable, revocable license to use the purchased files for your own personal or household use.

Your purchase does not transfer ownership of the intellectual property contained in the product.

Unless we provide prior written permission, you may not:

share or distribute the purchased files to others; sell, sublicense, rent, or commercially redistribute the files; upload the files to publicly accessible websites, file-sharing services, marketplaces, membership libraries, or shared repositories; reproduce the product for resale or commercial distribution; remove copyright or proprietary notices; or create derivative products primarily intended to reproduce, replace, or compete with New Homeowner OS.

You may make reasonable copies of the files for your own personal use, including storing backups, using them across your own devices, and printing copies for your household.

For clarity, one purchase is intended for one purchaser or household unless otherwise stated.


4. Educational Information and Home-Maintenance Disclaimer

The New Homeowner Operating System and all related content are provided for general educational and organizational purposes only.

The product is not a substitute for the advice, inspection, diagnosis, repair, installation, or services of a qualified contractor, tradesperson, engineer, electrician, plumber, HVAC technician, home inspector, fire-safety professional, environmental professional, legal professional, insurance professional, or other appropriately qualified expert.

Homes, building systems, equipment, climates, construction methods, manufacturer requirements, codes, regulations, and maintenance needs vary.

You are responsible for determining whether a recommendation is appropriate for your particular home and circumstances.

Manufacturer instructions, applicable laws, building codes, safety requirements, warranty requirements, and guidance from qualified professionals should take precedence where they differ from general information contained in our products.

Do not perform work that you are not qualified, permitted, equipped, or comfortable to perform.

Where a task involves electricity, gas, combustion equipment, structural components, hazardous materials, significant heights, specialized equipment, or other potentially dangerous conditions, professional assistance may be appropriate or legally required.

The Services are not intended for emergency use. In an emergency or potentially dangerous situation, contact the appropriate emergency service, utility, authority, or qualified professional.


5. Accuracy and Regional Differences

We make reasonable efforts to provide practical and accurate homeowner information and to base maintenance and safety guidance on reputable sources.

However, we do not guarantee that every recommendation will apply to every home, location, product, system, jurisdiction, or circumstance.

Guidance may differ between Canada and the United States and may also vary by province, territory, state, municipality, climate zone, manufacturer, or equipment type.

Information and recommendations may also change as standards, manufacturer guidance, regulations, or industry practices change.

You remain responsible for verifying information relevant to your specific home and location.


6. Software and File Compatibility

The New Homeowner Operating System may include files such as PDFs, fillable PDFs, spreadsheet files, calendar files, checklists, and other digital materials.

You are responsible for having compatible software, hardware, applications, and internet access necessary to use the files.

We make reasonable efforts to provide files in commonly supported formats, but we do not guarantee that every feature will function identically in every application, operating system, device, or third-party service.

For example, formatting, fillable PDF behavior, spreadsheet features, recurring calendar events, notifications, or alerts may vary depending on the application and settings used.

Third-party software and services are governed by their own terms and policies.


7. Orders and Digital Delivery

When you place an order, you are making an offer to purchase the selected product.

We reserve the right to accept, reject, cancel, or limit an order where reasonably necessary, including in cases of suspected fraud, payment problems, pricing errors, technical errors, unauthorized resale, or misuse of the Services.

Payment must be successfully processed before digital access is provided.

Digital products are generally delivered electronically after successful payment through a download page, email, customer account, or other digital-delivery method.

Although delivery is normally prompt, occasional technical delays may occur.

8. Refunds and Cancellations

Because our products are digitally delivered, cancellation or refund options may differ from those applicable to physical goods.

Refunds, cancellations, and other remedies are governed by our Refund & Digital Product Policy.

Nothing in our Refund Policy or these Terms limits any refund, cancellation, withdrawal, or other consumer right that cannot legally be excluded under applicable law.

Please review your order carefully before completing your purchase.


9. Prices, Currency, and Taxes

Unless otherwise stated, prices displayed by New Homeowner OS are shown in the currency indicated on the website.

Prices may change without notice. The price applicable to your purchase will be the price displayed when your order is submitted, subject to correction of obvious errors.

Applicable sales taxes, GST/HST, VAT, or other taxes may be calculated or collected where required.

You agree to provide accurate and authorized billing and payment information.


10. Intellectual Property

The Services and New Homeowner OS products, including their text, layouts, spreadsheets, checklists, databases, instructions, graphics, images, branding, designs, templates, downloads, and other original content, are owned by or licensed to New Homeowner OS and are protected by applicable copyright, trademark, and other intellectual-property laws.

Except for the limited personal-use license expressly granted under these Terms, no ownership or intellectual-property rights are transferred to you.

“New Homeowner OS,” “New Homeowner Operating System,” associated branding, logos, designs, and slogans may be trademarks or proprietary identifiers of New Homeowner OS.

Unauthorized copying, distribution, publication, resale, commercial exploitation, or sharing of our products is prohibited.


11. Optional Third-Party Tools

The Services may provide access to third-party tools, software, applications, payment services, calendar applications, spreadsheet applications, PDF readers, or other services that we do not control.

Third-party tools are provided subject to their own terms, privacy practices, availability, compatibility, and functionality.

Your use of third-party tools is at your discretion and may require acceptance of separate terms.

We are not responsible for changes, outages, errors, incompatibilities, or actions of third-party providers.

The Services or our products may contain links or references to websites, resources, agencies, manufacturers, standards organizations, or services operated by third parties.

Links are provided for convenience or informational purposes and do not necessarily constitute an endorsement.

13. Relationship With Shopify

New Homeowner OS is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are transactions directly between you and New Homeowner OS.

By using the Services, you acknowledge that Shopify is not responsible for the products purchased from New Homeowner OS or for any loss, injury, claim, or damage arising from those purchases, except to the extent otherwise required by applicable law.


14. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify may also collect and process certain information related to your access to and use of the Services.

Shopify's privacy information is available through Shopify's website.


15. Feedback and Reviews

If you voluntarily provide us with product feedback, suggestions, reviews, testimonials, comments, or other submissions, you represent that you have the right to provide that material.

Unless otherwise agreed, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and adapt that feedback for operating, improving, and promoting New Homeowner OS.

We will not intentionally attribute private customer correspondence to you publicly without appropriate permission.

You may not submit unlawful, defamatory, misleading, infringing, fraudulent, abusive, or malicious content.


16. Errors, Inaccuracies, and Updates

Occasionally information on our website or within our Services may contain typographical errors, outdated information, inaccuracies, or omissions.

Where an error materially affects an order, we may contact you and, where appropriate, cancel and refund the affected transaction.

We do not guarantee that the Services will be uninterrupted, error-free, compatible with every device or application, or suitable for every individual home or circumstance.

We do not guarantee that using the New Homeowner Operating System will prevent maintenance problems, property damage, equipment failure, safety incidents, financial losses, warranty issues, or other adverse outcomes.

Any warranties, conditions, guarantees, or consumer protections that cannot legally be excluded remain unaffected.


19. Limitation of Liability

To the fullest extent permitted by applicable law, New Homeowner OS and its owners, employees, contractors, service providers, licensors, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to your use of the Services or products.

This may include loss of data, loss of profits, loss of revenue, replacement costs, property damage, business interruption, or similar losses.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.


20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless New Homeowner OS and its owners, employees, contractors, affiliates, licensors, and service providers from third-party claims, liabilities, damages, or reasonable legal costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of the rights of another person.


21. Termination

We may suspend or terminate access to the Services where reasonably necessary because of fraud, abuse, unlawful activity, violation of these Terms, unauthorized distribution of our products, or other misuse.

Termination does not affect provisions that by their nature should survive, including intellectual-property rights, licensing restrictions, disclaimers, limitations of liability, and governing-law provisions.


22. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.


23. Entire Agreement and Waiver

These Terms, together with policies expressly incorporated by reference, constitute the agreement between you and New Homeowner OS regarding your use of the Services.

A failure by us to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.


24. Governing Law

These Terms of Service and any separate agreements through which we provide the Services will be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to any rights or protections that cannot be waived under applicable consumer-protection law, you and New Homeowner OS agree that any dispute arising out of or relating to these Terms or the Services will be subject to the jurisdiction of the courts located in Alberta, Canada.

Nothing in this section limits any mandatory consumer rights or remedies that may apply to you under the laws of your province, territory, state, or country of residence.

We may update these Terms from time to time to reflect changes to our business, products, Services, legal obligations, or practices.
